1. Kullanım Şartlarının Kabulü

Kitchen Studio mobil uygulamasını ("Uygulama") indirerek, yükleyerek, erişerek veya kullanarak, bu Kullanım Koşullarını ("Koşullar") kabul etmiş olursunuz. Bu Koşulları kabul etmiyorsanız, Uygulamayı kullanmayın.

Bu Koşullar, sizinle Kitchen Studio ("biz", "bizim" veya "uygulama") arasında Uygulamanın kullanımına ilişkin yasal olarak bağlayıcı bir anlaşma oluşturur.

2. Uygunluk ve Kullanıcı Hesapları

2.1 Yaş Gereksinimleri

Uygulamayı kullanmak için en az 4 yaşında olmalısınız. 13 yaşın altındaysanız, Uygulamayı yalnızca ebeveyn veya yasal vasinizin izni ve gözetimi altında kullanabilirsiniz.

2.2 Hesap Oluşturma

Belirli özelliklere erişmek için şunları sağlayarak bir hesap oluşturmalısınız:

• Geçerli bir e-posta adresi
• Tam adınız
• Güvenli bir şifre

Doğru, güncel ve eksiksiz bilgi sağlamayı ve gerektiğinde bilgilerinizi güncellemeyi kabul edersiniz.

2.3 Hesap Güvenliği

Şunlardan siz sorumlusunuz:

• Hesap kimlik bilgilerinizin gizliliğini korumak
• Hesabınız altında gerçekleşen tüm faaliyetler
• Yetkisiz erişim durumunda bizi derhal bilgilendirmek

2.4 Hesap Sonlandırma

Hesabınızı istediğiniz zaman Uygulama ayarlarından silebilirsiniz. Bu Koşulları ihlal ederseniz veya dolandırıcılık, kötüye kullanım veya yasa dışı faaliyetlerde bulunursanız hesabınızı askıya alma veya sonlandırma hakkını saklı tutarız.

3. Kullanıcı Davranışı ve Yasaklı Faaliyetler

3.1 Kabul Edilebilir Kullanım

Uygulamayı yalnızca yasal amaçlar için ve bu Koşullara uygun olarak kullanmayı kabul edersiniz.

3.2 Yasaklı Faaliyetler

Şunları YAPAMAZSINIZ:

• Yasadışı, zararlı veya saldırgan içerik yüklemek
• Diğer kullanıcıları taciz etmek, zorbalık yapmak veya tehdit etmek
• Spam veya istenmeyen reklam göndermek
• Başkalarının kimliğine bürünmek
• Uygulamanın güvenliğini tehlikeye atmaya çalışmak
• Otomatik araçlar (botlar, kazıyıcılar) kullanmak
• Ödeme sistemlerini atlamak veya Premium hesapları paylaşmak
• Açıklanmayan alerjenler veya güvenli olmayan gıda uygulamaları içeren tarifler paylaşmak

3.3 Tarif İçerik Kuralları

Tarif oluştururken ve paylaşırken:

• Doğru malzeme listeleri ve ölçümler sağlayın
• Gerektiğinde alerjen uyarıları ekleyin
• Güvenli gıda işleme ve pişirme uygulamalarını izleyin
• Yalnızca orijinal içerik veya uygun şekilde atfedilmiş içerik kullanın

4. AI Özellikleri ve Sorumluluk Reddi

4.1 AI Şef İşlevselliği

AI Şef özelliğimiz, şunlara dayalı kişiselleştirilmiş tarif önerileri oluşturmak için yapay zeka kullanır:

• Diyet tercihleriniz ve kısıtlamalarınız
• Envanterinizdeki mevcut malzemeler
• Yemek türü ve mutfak tercihleri
• Pişirme süresi kısıtlamaları

4.2 Doğruluk Sorumluluk Reddi

ÖNEMLİ: AI tarafından oluşturulan içerik hatalar içerebilir.

Doğruluk için çaba göstermemize rağmen, şunları garanti edemeyiz:

• Tüm tariflerin mükemmel veya zevkinize uygun olacağı
• Malzeme kombinasyonlarının her zaman beklendiği gibi çalışacağı
• Pişirme süreleri ve sıcaklıklarının tüm durumlar için optimal olduğu
• AI önerilerinin tüm diyet kısıtlamaları için güvenli olduğu

Kullanmadan önce tüm AI tarafından oluşturulan içeriği kişisel muhakemenizle doğrulamalısınız.

4.3 Diyet ve Alerji Uyarıları

Uygulama, profesyonel tıbbi, beslenme veya diyet tavsiyesinin yerine GEÇ MEZ.

Şunlardan yalnızca siz sorumlusunuz:

• Tüm malzemeleri alerjenler için doğrulamak
• Tarifleri diyet kısıtlamalarınıza göre kontrol etmek
• Tıbbi diyet ihtiyaçları için sağlık uzmanlarına danışmak
• Gıda güvenliği ve uygun işlemeyi sağlamak

Kitchen Studio, Uygulama tarafından sağlanan tarifler veya önerilerden kaynaklanan alerjik reaksiyonlar, gıda zehirlenmesi veya sağlık sorunlarından sorumlu DEĞİLDİR.

5. Abonelikler ve Ödemeler

5.1 Premium Abonelik Seçenekleri

Kitchen Studio aşağıdaki abonelik seçeneklerini sunar:

• Aylık Premium: AI Şef, gelişmiş bütçe yönetimi, reklamsız deneyim, 5 aile üyesine kadar
• Aile Premium (Yıllık): Tüm Aylık Premium özellikleri, 5 aile üyesine kadar
• Reklamsız: Yalnızca reklamsız deneyim

5.2 Fiyatlandırma ve Faturalandırma

• Fiyatlar yerel para biriminizde görüntülenir
• Ödeme Apple ID hesabınızdan tahsil edilir
• Fiyatlar 30 gün önceden bildirimle değiştirilebilir

5.3 Otomatik Yenileme

Abonelikler, mevcut dönemin bitiminden en az 24 saat önce iptal edilmedikçe otomatik olarak yenilenir. Hesabınız, mevcut dönemin bitiminden 24 saat önce yenileme için ücretlendirilecektir.

5.4 İptal

Aboneliğinizi iptal etmek için:

1. iPhone Ayarları'nı açın
2. Adınıza dokunun → Abonelikler
3. Kitchen Studio'yu seçin
4. "Aboneliği İptal Et"e dokunun

5.5 İade

Tüm satın almalar Apple App Store üzerinden işlenir. İade talepleri Kitchen Studio'ya değil, Apple'a gönderilmelidir.

6. Fikri Mülkiyet Hakları

6.1 Kitchen Studio'nun Fikri Mülkiyeti

Uygulama, yazılım kodu, kullanıcı arayüzü tasarımı, AI algoritmaları, ticari markalar ve önceden yüklenmiş içerik dahil olmak üzere tüm haklar Kitchen Studio'ya aittir.

6.2 Uygulamayı Kullanma Lisansı

Size Uygulamayı kişisel, ticari olmayan amaçlar için kullanmak üzere sınırlı, münhasır olmayan, devredilemez, iptal edilebilir bir lisans veriyoruz.

7. Kullanıcı Tarafından Oluşturulan İçerik (UGC) Politikası

7.1 Kullanıcı Beyanı ve Garantisi

Platforma metin, tarif, fotoğraf veya başka herhangi bir içerik ("Kullanıcı İçeriği") göndererek, yükleyerek veya paylaşarak; söz konusu İçeriğin tüm fikri mülkiyet haklarının tamamen ve münhasıran size ait olduğunu veya bu İçeriği platformda paylaşmak ve işbu Koşullarda belirtilen lisansları bize vermek için gerekli tüm yasal haklara, lisanslara ve açık izinlere sahip olduğunuzu peşinen beyan ve taahhüt edersiniz. Ayrıca, yüklediğiniz Kullanıcı İçeriğinin üçüncü şahıslara ait telif hakkı, marka, patent, ticari sır, gizlilik veya diğer mülkiyet haklarını hiçbir şekilde ihlal etmediğini garanti edersiniz.

7.2 Genişletilmiş Lisans Hakları

Kullanıcı İçeriğinizin mülkiyeti her zaman size ait kalacaktır. Ancak, Platforma içerik yükleyerek bize; bu metinleri, tarifleri ve fotoğrafları kullanma, kopyalama, çoğaltma, değiştirme, uyarlama, türev eserler oluşturma, dağıtma, yayımlama ve sergileme konusunda dünya çapında geçerli, münhasır olmayan, telifsiz (royalty-free), devredilebilir ve alt lisanslanabilir geniş bir kullanım hakkı vermiş olursunuz. Bu lisans, yüklediğiniz içeriklerin şirketimiz tarafından dijital pazarlama faaliyetlerimiz kapsamında, resmi sosyal medya hesaplarımızda ve diğer kanallarda, size herhangi bir ek ücret ödenmeksizin veya ön bildirimde bulunulmaksızın serbestçe kullanılma hakkını da kapsamaktadır.

7.3 İçerik Moderasyonu ve Kaldırma Hakkı

Platformumuzun, yüklenen Kullanıcı İçeriklerini yayınlanmadan önce filtreleme, inceleme veya sürekli olarak izleme gibi bir yasal zorunluluğu bulunmamaktadır. Ancak platformumuz, tamamen tek taraflı takdirine bağlı olarak, herhangi bir ihtar veya ön bildirim vermeksizin, dilediği zaman Kullanıcı İçeriklerini izleme, denetleme veya sistemden kaldırma hakkını saklı tutar. Politikalarımızı ihlal eden, telif hakkı barındıran, çalıntı/kopya şüphesi taşıyan veya uygunsuz/yasa dışı olduğuna kanaat getirdiğimiz herhangi bir içeriği anında yayından kaldırabilir ve ilgili kullanıcının hesabını askıya alabilir veya kalıcı olarak silebiliriz.

7.4 Tazminat

Platforma yüklediğiniz kopyalanmış, çalıntı veya izinsiz bir fotoğraf, tarif veya içerik nedeniyle telif hakkı sahiplerinden veya üçüncü kişilerden gelebilecek her türlü şikayet, dava veya hukuki süreçten tamamen ve şahsen siz sorumlu olacaksınız. İşbu maddelere aykırı hareket etmeniz sonucunda şirketimizin, platformumuzun, yöneticilerimizin ve çalışanlarımızın uğrayacağı doğrudan ve dolaylı tüm maddi zararları, idari para cezalarını, yargılama giderlerini ve avukatlık masraflarını ilk talepte, nakden ve defaten eksiksiz olarak tazmin edeceğinizi kabul ve taahhüt edersiniz.

7.5 Telif Hakkı İhlali Bildirim Prosedürü (Uyar-Kaldır Sistemi)

Başkalarının fikri mülkiyet haklarına en üst düzeyde saygı gösteriyor ve kullanıcılarımızdan da aynısını bekliyoruz. Eğer bir telif hakkı sahibiyseniz veya yetkili temsilcisiyseniz ve platformumuzdaki bir içeriğin telif haklarınızı ihlal ettiğini düşünüyorsanız, resmi "Telif Hakkı İhlali Bildirimi" talebinizi aşağıdaki bilgileri içerecek şekilde bize iletebilirsiniz:

• İhlal edildiği öne sürülen telif hakkı sahibinin veya yetkili temsilcisinin fiziki veya elektronik imzası,
• İhlale konu olan orijinal telif hakkı alınmış eserin kanıtı ve tanımı,
• Platform üzerinde nerede bulunduğunu tespit etmemize yarayacak ihlal eden içeriğin linki (URL adresleri),
• Sizinle iletişime geçebilmemiz için telefon numarası ve e-posta adresi gibi iletişim bilgileriniz.

Lütfen tüm telif hakkı bildirimleri ve içerik kaldırma taleplerini şu adrese gönderiniz: info@getkitchenstudio.com. Geçerli bir bildirim aldığımızda, itiraz edilen içeriğin platformdan anında kaldırılması da dahil olmak üzere, yasalara uygun adım atma işlemlerini derhal gerçekleştireceğimizi tek taraflı olarak bildiririz.

8. Aile Grupları

Kullanıcılar, tarifler, alışveriş listeleri ve bütçeleri aile üyeleriyle paylaşmak için Aile Grupları oluşturabilir. Grubu oluşturan kullanıcı Yönetici olur ve grup üzerinde tam kontrole sahiptir.

Bir Aile Grubuna katılarak, bu verileri grup üyeleriyle paylaşmayı kabul edersiniz.

9. Üçüncü Taraf Hizmetler

Uygulama şu üçüncü taraf hizmetleriyle entegre olur:

• Supabase: Veri depolama ve kimlik doğrulama
• RevenueCat: Abonelik yönetimi
• Google Gemini: AI Şef özellikleri
• Google Sign-In: Kimlik doğrulama
• OneSignal: Push bildirimleri
• Google Mobile Ads: Reklamlar (ücretsiz kullanıcılar için)

Bu hizmetlerin kullanımı, ilgili hüküm ve koşullarına tabidir.

10. Sorumluluk Reddi ve Sorumluluk Sınırlaması

10.1 "Olduğu Gibi" Sorumluluk Reddi

UYGULAMA "OLDUĞU GİBİ" VE "MEVCUT OLDUĞU ŞEKLİYLE" HİÇBİR GARANTİ OLMAKSIZIN SAĞLANIR.

10.2 Sorumluluk Sınırlaması

YASALARIN İZİN VERDİĞİ AZAMİ ÖLÇÜDE, KITCHEN STUDIO ŞUNLARDAN SORUMLU OLMAYACAKTIR:

• Dolaylı, arızi, özel veya cezai zararlar
• Kar, gelir, veri veya kullanım kaybı
• Hizmet kesintileri veya gecikmeler
• Gıda ile ilgili yaralanmalar, alerjik reaksiyonlar veya sağlık sorunları

10.3 Azami Sorumluluk

Uygulamanın kullanımından kaynaklanan herhangi bir iddia için toplam sorumluluğumuz, son 12 ayda Kitchen Studio'ya ödediğiniz tutarı veya 100 USD'yi (hangisi daha azsa) aşmayacaktır.

11. Sonlandırma

Hesabınızı istediğiniz zaman silebilirsiniz. Ayrıca bu Koşulları ihlal ederseniz hesabınızı askıya alma veya sonlandırma hakkını saklı tutarız.

Sonlandırma üzerine:

• Kişisel verileriniz 30 gün içinde silinecektir
• Tüm Uygulama özelliklerine erişiminizi kaybedersiniz
• Premium abonelikler iptal edilir (iade yapılmaz)

12. Değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. Önemli değişiklikler olduğunda uygulama içi bildirim göndereceğiz. Değişikliklerden sonra Uygulamayı kullanmaya devam etmeniz, yeni Koşulları kabul ettiğiniz anlamına gelir.

1. Acceptance of Terms

By downloading, installing, accessing, or using the Kitchen Studio mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Kitchen Studio ("we," "us," or "our") regarding your use of the App.

2. Eligibility and User Accounts

2.1 Age Requirements

You must be at least 4 years old to use the App. If you are under 13 years of age, you may only use the App with the consent and supervision of a parent or legal guardian.

2.2 Account Creation

To access certain features, you must create an account by providing:

• A valid email address
• Your full name
• A secure password

You agree to provide accurate, current, and complete information and to update your information as necessary.

2.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

2.4 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

3. User Conduct and Prohibited Activities

3.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

3.2 Prohibited Activities

You may NOT:

• Upload illegal, harmful, or offensive content
• Harass, bully, or threaten other users
• Post spam or unsolicited advertising
• Impersonate others or misrepresent your identity
• Attempt to compromise the App's security
• Use automated tools (bots, scrapers) to access the App
• Circumvent payment systems or share Premium accounts
• Share recipes containing undisclosed allergens or unsafe food practices

3.3 Recipe Content Guidelines

When creating and sharing recipes, you must:

• Provide accurate ingredient lists and measurements
• Include allergen warnings where applicable
• Follow safe food handling and cooking practices
• Use only original content or properly attributed content

4. AI Features and Disclaimers

4.1 AI Chef Functionality

Our AI Chef feature uses artificial intelligence to generate personalized recipe suggestions based on:

• Your dietary preferences and restrictions
• Available ingredients in your inventory
• Meal type and cuisine preferences
• Cooking time constraints

4.2 Accuracy Disclaimer

IMPORTANT: AI-generated content may contain errors.

While we strive for accuracy, we cannot guarantee that:

• All recipes will be perfect or suitable for your taste
• Ingredient combinations will always work as expected
• Cooking times and temperatures are optimal for all situations
• AI suggestions are safe for all dietary restrictions

You must use your personal judgment and verify all AI-generated content before use.

4.3 Dietary and Allergy Warnings

The App is NOT a substitute for professional medical, nutritional, or dietary advice.

You are solely responsible for:

• Verifying all ingredients for allergens
• Checking recipes against your dietary restrictions
• Consulting healthcare professionals for medical dietary needs
• Ensuring food safety and proper handling

Kitchen Studio is NOT liable for allergic reactions, food poisoning, or health issues resulting from recipes or suggestions provided by the App.

5. Subscriptions and Payments

5.1 Premium Subscription Options

Kitchen Studio offers the following subscription options:

• Monthly Premium: AI Chef, advanced budget management, ad-free experience, up to 5 family members
• Family Premium (Yearly): All Monthly Premium features, up to 5 family members
• No Ads: Ad-free experience only

5.2 Pricing and Billing

• Prices are displayed in your local currency
• Payment is charged to your Apple ID account
• Prices are subject to change with 30 days' notice

5.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.4 Cancellation

To cancel your subscription:

1. Open iPhone Settings
2. Tap your name → Subscriptions
3. Select Kitchen Studio
4. Tap "Cancel Subscription"

5.5 Refunds

All purchases are processed through the Apple App Store. Refund requests must be submitted to Apple, not Kitchen Studio.

6. Intellectual Property Rights

6.1 Kitchen Studio's Intellectual Property

All rights, title, and interest in the App, including software code, user interface design, AI algorithms, trademarks, and pre-loaded content are owned by Kitchen Studio.

6.2 License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

7. User-Generated Content (UGC) Policy

7.1 User Representations & Warranties

By posting, uploading, or submitting any texts, recipes, photographs, or other content ("User Content") to the Platform, you represent and warrant that you are the sole and exclusive owner of all rights, title, and interest in and to such User Content, or that you have obtained all necessary licenses, explicit permissions, consents, and releases to share such content and grant us the licenses specified in these Terms. You further represent and warrant that your User Content does not infringe, misappropriate, or violate any third party's patent, copyright, trademark, trade secret, moral rights, privacy rights, or other intellectual property or proprietary rights.

7.2 Extended License Scope

While you retain full ownership of your User Content, by uploading or submitting it to the Platform, you hereby grant us a worldwide, non-exclusive, royalty-free, fully paid-up, transferable, and sublicensable extended license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display your User Content (including texts, recipes, and photos). This expressly includes, but is not limited to, the right to use your User Content for our own marketing and promotional activities, including on our official social media channels, advertisements, and other digital platforms, without any further compensation or explicit notice to you.

7.3 Right to Monitor & Remove Content

We are not obligated to monitor, pre-screen, verify, or edit User Content prior to publication. However, we reserve the right, in our sole and absolute discretion, to monitor, review, hide, or remove any User Content at any time and for any reason, without prior notice or warning. We may immediately delete or remove User Content and unilaterally suspend or terminate the account of any user who violates these Terms, infringes upon intellectual property rights, posts stolen photographs/recipes, or publishes content that we deem abusive, illegal, or inappropriate.

7.4 Indemnification

You agree to defend, indemnify, and hold harmless our company, the Platform, our affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, administrative fines, and expenses (including but not limited to attorney's fees) arising from complaints, lawsuits, or legal proceedings initiated by copyright owners or third parties due to stolen, copied, or unauthorized User Content you have submitted. This indemnification obligation will survive these Terms and your use of the Platform.

7.5 Copyright Infringement & DMCA Notice (Notice and Takedown System)

We respect the intellectual property rights of others and strictly expect our users to do the same. If you are a copyright owner or an authorized agent thereof and believe that any User Content on our platform infringes upon your copyrights, you may submit a formal Copyright Infringement Notice pursuant to the Digital Millennium Copyright Act ("DMCA") or applicable local laws containing the following information:

• A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright;
• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material that is claimed to be infringing, along with direct links (URLs) to help us locate the content on the Platform;
• Information reasonably sufficient to permit us to contact you, such as your address, telephone number, and email address.

Please send all copyright infringement notices and takedown requests directly to: info@getkitchenstudio.com. Upon receipt of a valid notice, we will take whatever action we deem appropriate in our sole discretion, including the prompt removal of the challenged material from the Platform.

8. Family Groups

Users can create Family Groups to share recipes, shopping lists, and budgets with family members. The user who creates the group becomes the Admin and has full control over the group.

By joining a Family Group, you consent to sharing this data with group members.

9. Third-Party Services

The App integrates with the following third-party services:

• Supabase: Data storage and authentication
• RevenueCat: Subscription management
• Google Gemini: AI Chef features
• Google Sign-In: Authentication
• OneSignal: Push notifications
• Google Mobile Ads: Advertising (for free users)

Your use of these services is subject to their respective terms and conditions.

10. Disclaimers and Limitation of Liability

10.1 "As Is" Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KITCHEN STUDIO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or punitive damages
• Loss of profits, revenue, data, or use
• Service interruptions or delays
• Food-related injuries, allergic reactions, or health issues

10.3 Maximum Liability

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to Kitchen Studio in the 12 months preceding the claim, or $100 USD, whichever is less.

11. Termination

You may delete your account at any time. We also reserve the right to suspend or terminate your account if you violate these Terms.

Upon termination:

• Your personal data will be deleted within 30 days
• You lose access to all App features
• Premium subscriptions are cancelled (no refunds)

12. Changes to Terms

We may update these Terms from time to time. When there are significant changes, we will send an in-app notification. Continued use of the App after changes means you accept the new Terms.
